About US:
The Public Procurement and Disposal of Public Assets Authority (PPDA) is established under the PPDA Act No.1 of 2003 to develop standards and regulate procurement and disposal practices in respect of all Procuring and Disposing Entities which include Central Government Ministries and Departments, Local Governments, State Enterprises, Constitutional and Statutory Bodies and post primary training institutions.
Job Summary: The Senior Officer Legal will implement of the legal and board affairs work plan ensuring that quality and relevant standards are developed for Authority implementation and the quality of legal services provided are responsive and meet the expectations of all stakeholders.
Key Duties and Responsibilities:
Actively participate in the development and setting of standards by identifying issues from the compliance monitoring mechanism:
- Keenly review the necessary information to inform the development of standards that address and respond to the improvement of procurement standards.
- Prepare, and update circulars, SBDs and guidelines for approval
- Actively participate in stakeholders meetings to agree on content and best practice and to solicit opinions / feedback for the guidelines, circulars & SBDs improvement prior to issue
- Draft new SBDs or changes required to new ones ensuring that they relevant and responsive to findings identified from evidence based surveys/ research etc. and sharing with the Manager for review and quality control.
Successfully defend cases brought against PPDA ensuring that costs/ impact to the authority are minimal:
- Receive applications (for PPDA Tribunals); file replies to the application within specific time frames; respond to written submissions (filed by the other party) and give oral submissions in tribunal
- Take part in judicial reviews and civil cases to ensure PPDA’s interests are well represented.
- Participate in court processes where necessary.
- Attend court/tribunal hearings as legal representative of PPDA.
Participate in the delivery of MAC services as and when required resulting in the efficient implementation of MAC action points:
- Receive documents related to MAC matters and review these documents and respond to them within periods required.
- Actively contribute to the development of the agenda prior to MAC meeting
- Coordinate the organisation of suspensions ensuring that all the relevant and required participants have been informed.
- Guide case officers on writing of reports on evaluation process. Issue reports from case officers after approval
- Follow-up the implementation of MAC recommendations ensuring that they have been implemented
- Prepare and submit performance status reports on all MAC issues so that all members and stakeholder are up to date with status of completion.
- Ensure that all communications regarding cases that do not require hearings are managed in a timely manner.
- Prepare reports – weekly and quarterly for management consideration related to MAC matters.
- Follow up on information requested from various entities contributing to the resolution of cases
- Prepare board papers for approval
Qualifications, Skills and Experience:
- The ideal candidate for the PPDA Senior Officer Legal job opportunity should hold an Honours First degree in Law LLB (Hons)
- Possession of a Post Graduate Diploma in Legal Practice
- Post Graduate Diploma in Procurement or full membership of CIPS
- At least three years’ experience in legal service (delivery or research)
- Familiarity with the PPDA Act
